# Terms of Service — La Ñapa

These Terms of Service ("Terms") govern your use of **La Ñapa** — the
restaurant staff-management and reservations application (web and iOS)
operated by **La Ñapa Market** ("we," "us"), a restaurant at 656 Nostrand
Ave, Brooklyn, NY 11216. The app covers reservations, guest profiles,
staff scheduling, shift swaps, time off, team messaging, checklists, and
related restaurant operations ("the Service").
By signing in to or using the Service you agree to these Terms. If you do
not agree, do not use the Service.

## 1. Who may use the Service
The Service is a business tool for restaurant staff and management.
Accounts are created and role-assigned by restaurant management; there is
no public self-registration for staff surfaces. You must be at least 16
years old and authorized by the restaurant to hold an account.
Guest-facing surfaces (the reservation widget and confirmation/cancel/
modify pages) may be used by guests solely to manage their own
reservations.

## 2. Accounts and security
- Keep your login credentials (including any shared device PIN) secret.
You are responsible for activity under your account.
- Provide accurate information and keep your contact details current.
- Tell a manager or email `info@lanapamarket.com` immediately if you
suspect your account has been compromised.
- Shared accounts (e.g. the Host Stand iPad) are restricted by design;
do not use them to bypass per-person access controls.

## 3. Acceptable use
You agree NOT to:
- access another person's account, data, or messages without authorization;
- use guest data (names, phone numbers, emails, dietary notes, visit
history) for any purpose other than performing your job at the
restaurant;
- harass, threaten, or discriminate against anyone through the
messaging, forum, or any other surface;
- probe, scan, overload, or attempt to breach the Service's security or
rate limits, or reverse-engineer non-public parts of the Service;
- upload malware or content that is unlawful or infringes someone else's
rights;
- scrape or bulk-export data except through features we provide for that
purpose.
We may remove content and suspend accounts that violate this section.

## 4. Your employment is separate
The Service is a workplace tool. Nothing in these Terms creates, modifies,
or replaces your employment relationship, wages, schedule entitlements, or
any rights you have under applicable labor law. Nothing in these Terms
restricts rights protected by Section 7 of the National Labor Relations
Act (including discussing wages and working conditions). Workplace
monitoring notices required by law (e.g. NY Civil Rights Law §52-c) are
provided and acknowledged separately in-app.

## 5. Content and data
You retain ownership of content you submit (messages, notes, checklist
entries, photos). You grant us a non-exclusive license to host, store,
display, and process that content as needed to operate the Service.
Operational records (reservations, schedules, audit logs) are business
records of the restaurant.

## 6. Privacy
How we collect, use, and protect personal data is described in our
[Privacy Policy](/privacy). The Privacy Policy is part of how the Service
operates, and using the Service means your data is handled as described
there.

## 7. Service changes and availability
We are actively developing the Service and may add, change, or remove
features at any time. We aim for high availability but do not guarantee
the Service will be uninterrupted or error-free. Scheduled features (e.g.
reminders, notifications) are best-effort and must not be your only
safeguard for legally required processes.

## 8. Suspension and termination
- Restaurant management may deactivate or offboard staff accounts at any
time (e.g. when employment ends). Offboarding cancels future shifts and
pending requests; past work history is preserved as a business record.
- We may suspend or terminate access immediately for violation of these
Terms or to protect the Service or its users.
- You may request deletion of your account as described in the Privacy
Policy; some records are retained where the law requires it.

## 9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF
ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT
THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT
DATA (INCLUDING SCHEDULES AND RESERVATIONS) WILL ALWAYS BE ACCURATE OR
AVAILABLE.

## 10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LA ÑAPA MARKET WILL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,
OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE
OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE
WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO
NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO
YOU. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED BY LAW,
INCLUDING RIGHTS UNDER APPLICABLE EMPLOYMENT LAW.

## 11. Governing law
These Terms are governed by the laws of the State of New York, without
regard to its conflict-of-laws rules. Any dispute arising out of these
Terms or the Service will be brought in the state or federal courts
located in Kings County, New York, and you consent to their jurisdiction.

## 12. Changes to these Terms
We may update these Terms as the Service evolves. The "Last updated" date
at the top reflects the most recent change. Material changes will be
communicated via in-app notice or email; continued use of the Service
after changes take effect constitutes acceptance.
